Client Agreement, Policies & Liability Waiver

Nick Wagner Massage & Bodywork LLC — San Francisco, CA


This Client Agreement, Policies & Liability Waiver (“Agreement”) governs massage and bodywork services provided by Nick Wagner Massage & Bodywork LLC (“Practitioner”). By booking an appointment, receiving services, and/or signing below, Client knowingly and voluntarily agrees to the following:

Scope of Practice

  1. Practitioner provides massage therapy, myofascial release, and biodynamic craniosacral therapy.

  2. Services are not intended to diagnose, treat, cure, or prevent any medical condition and are not a substitute for medical care.

  3. Practitioner does not provide medical diagnosis or prescription and may refer Client to another licensed healthcare provider if services requested fall outside the Practitioner’s scope of practice.

Client Responsibilities

  1. Client agrees to fully disclose all relevant medical conditions, injuries, medications, and health history prior to each session and to update Practitioner of any changes.

  2. Client acknowledges that failure to disclose relevant health information may increase the risk of injury.

  3. Client agrees to reschedule appointments if experiencing a contagious illness.

  4. For minors under 18, written consent from a parent or legal guardian is required.

    • Clients under age 16 must have a parent or guardian present.

    • For ages 16–17, parent or guardian presence is optional.

Professional Boundaries

  1. All services are provided strictly within a professional therapeutic context.

  2. Sexual harassment, solicitation, or inappropriate behavior will result in immediate termination of the session, and the full session fee will be charged.

  3. Practitioner reserves the right to refuse or terminate services at any time to maintain safety, professional boundaries, or therapeutic appropriateness.

Scheduling, Cancellation, and No-Show Policy

  1. A valid credit card is required to book an appointment.

  2. Credit cards will only be charged for late cancellations or no-shows in accordance with this policy.

  3. Client must provide a minimum of 48 hours’ notice to cancel or reschedule.

  4. Appointments cancelled with less than 48 hours’ notice will be charged the full session fee.

  5. A no-show is defined as failure to arrive or communicate by phone, text, or email within 20 minutes of the scheduled start time. No-shows will be charged the full session fee.

  6. Exceptions may be granted at Practitioner’s discretion for illness or genuine emergencies.

Late Arrivals

  1. Sessions will conclude at the originally scheduled end time.

  2. If Practitioner’s schedule allows, a session may be extended; however, this is not guaranteed.

  3. The full session fee applies regardless of arrival time.

Payment Policies

  1. Payment is due at the end of each session unless otherwise agreed upon in advance.

  2. Accepted payment methods include cash, check, credit/debit card, Venmo, and Zelle.

  3. Practitioner does not bill insurance but can provide a superbill or invoice for possible reimbursement.

Building Rules

Client agrees to comply with all rules governing the office building, including but not limited to the following:

  1. No hazardous waste disposal or dumping. Restroom trash receptacles are for paper towels only.

  2. Hallways and common areas must remain clear at all times. Storage in common areas is prohibited.

  3. Firearms are prohibited anywhere within the building.

  4. Clients must not damage walls, doors, floors, or any material portion of the building.

  5. There is no client access to the parking garage.

  6. Smoking or vaping of any kind is prohibited within 25 feet of operable doors and windows, in accordance with California law.

  7. Storage, use, or distribution of illegal drugs is strictly prohibited on the premises.

Violation of building rules may result in immediate termination of services and refusal of future appointments.

Assumption of Risk

Client understands and acknowledges that massage therapy and bodywork involve physical contact and movement of soft tissue and joints, which may result in temporary soreness, tenderness, bruising, emotional release, or other physical responses. Client voluntarily assumes all risks associated with receiving these services.

Waiver of Liability & Release

To the fullest extent permitted under California law, Client hereby:

  1. Releases and waives any and all claims against Nick Wagner Massage & Bodywork LLC and its Practitioner for injury, loss, or damage arising out of participation in massage or bodywork services, including claims based on ordinary negligence.

  2. Agrees that this waiver does not apply to claims arising from gross negligence, reckless conduct, or intentional misconduct.

  3. Agrees to indemnify and hold harmless Nick Wagner Massage & Bodywork LLC from any claims, damages, or expenses arising from Client’s failure to disclose relevant health information or comply with this Agreement.

Consent to Treatment

Client consents to receive massage and bodywork services and acknowledges the right to stop or modify treatment at any time by communicating with the Practitioner.

Governing Law & Venue

This Agreement shall be governed by and interpreted in accordance with the laws of the State of California. Any dispute arising under this Agreement shall be resolved in San Francisco County, California.

Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

Acknowledgment & Agreement

By signing below, Client confirms that they have read, understood, and voluntarily agreed to all terms of this Agreement.
